Winnable Terms of Service

These terms are an agreement between you and Winnable Health, Inc. ("Winnable," "we," "us"). By creating a Winnable account, you agree to these Terms of Service and our Privacy Policy.

1. What Winnable is

Winnable helps you plan movement, exercise, and wind-down time around your calendar and wearable data. It is a scheduling and wellness tool, not a medical device, and nothing in the app is medical advice, a diagnosis, or a treatment recommendation. Talk to a doctor about your actual health.

2. Your account

You must be 18 or older to use Winnable. You're responsible for the security of your account and for keeping your Google and Oura connections accurate.

3. Subscriptions and billing

  • Winnable is offered at $99 per year or $14.99 per month, with a 14-day free trial.
  • Your trial converts automatically to a paid subscription unless you cancel before it ends.
  • Subscriptions renew automatically until canceled. You can cancel anytime from account settings; cancellation takes effect at the end of the current billing period.
  • We do not offer partial refunds. If you request a refund within 7 days of being charged, we will refund that charge in full. Requests made more than 7 days after a charge are not eligible.

4. Calendar behavior

Winnable writes only to a single, dedicated secondary calendar it creates in your Google account. We will never create, modify, move, or delete an event on your primary calendar or any event you created yourself.

5. Acceptable use

You won't use Winnable to violate any law, attempt to access another user's data, reverse-engineer the service, or use it in a way that could disrupt the Google Calendar or Oura APIs for other users.

6. Data ownership

Your data is yours. We use it only as described in the Privacy Policy.

7. Disclaimers and limitation of liability

Winnable is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Winnable depends on the Google Calendar API and the Oura API to function; we don't control their uptime or accuracy, and we don't guarantee uninterrupted, timely, or error-free service.

To the maximum extent permitted by law, Winnable and its officers, employees, and agents won't be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising from your use of the service. Our total liability for any claim arising from these terms or your use of Winnable is limited to the amount you paid us in the 12 months before the claim arose.

Nothing in this section limits liability where the law doesn't allow it to be limited, such as liability for our gross negligence, willful misconduct, or fraud.

8. Termination

We can suspend or terminate accounts that violate these terms. You can delete your account at any time from settings.

9. Changes to these terms

We may update these terms. We'll notify you of material changes before they take effect.

10. Governing law

These terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles, and any dispute arising from them will be resolved in the state or federal courts located in Delaware.
